This Privacy Policy explains how Diamond Kinetics, SidelineHD, and MLB Universe Services (“Diamond Kinetics,” “we,” “our,” or “us”) collects, uses, shares, and protects your information when you use our services. This policy is part of our Combined Terms of Use.
I. SCOPE OF THIS POLICY
This policy applies to all Personal Information and data collected in connection with our technology-enabled platforms, websites, mobile applications (Apps), and related services (collectively, the “Diamond Kinetics, SidelineHD, and MLB Universe Services”).
The Diamond Kinetics, SidelineHD, and MLB Universe Services Covered by This Policy Include:
- Diamond Kinetics websites and mobile applications.
- SidelineHD websites and mobile applications.
- MLB Universe websites and mobile applications.
- All related online features, including live streaming, video clips, in-app messaging, and forums.
If you do not agree with this policy, please do not use our Services. By accessing or using the Services, you agree to this Privacy Policy and our Combined Terms of Use.
II. INFORMATION WE COLLECT
We collect information in three main categories:
1. Information You Provide Directly (Personal Information)
This is data you provide when you register, purchase a subscription, or use the Services. It may include:
- Contact & Identity: Name, email address, mailing address, telephone number, gender, birthdate, password.
- Financial: Payment-related information provided during transactions (processed by third-party payment processors).
- Performance & Athletic Data: Performance scores/ratings (e.g., throwing velocity), affiliated sports team names, jersey numbers, academic info (grade level, GPA), and data collected through connected sensors or devices.
- User Content: Any content, photos, audio, or video you upload, post, or share on the Services.
- Correspondence: Records of emails and communications if you contact us.
2. Information from Third Parties
We may collect information about you from external sources, including:
- Scoring & Sensors: Third-party scoring systems (e.g., iScore), sensors (e.g., velocity measurement, fitness monitors), and data from connected social media sites.
- Non-User Information: If you provide information about another individual (a "Non-User"), you confirm you have their consent (or the consent of their parent/guardian) to share that Personal Information with us.
- Non-User Consent. You represent and warrant that for all User Content (including but not limited to livestreams of youth sports events) that includes information about any individuals, players, organizations, or teams (each a "Non-User"), you have received express written consent from all Non-Users (or their parent/legal guardian if under 18) to include that information.
3. Information Collected Automatically
When you interact with the Services, we automatically collect data about your activity, equipment, and usage patterns:
- Usage Details: Traffic data, logs, access details, and how you interact with content.
- Device Information: IP address, device type, operating system, browser type, and unique device identifiers.
- Location Information: If you grant permission, we may collect your device's location data.
- Tracking Technologies: We use cookies, web beacons, pixels, software development kits (SDKs), and similar technologies to remember your preferences, track usage, conduct analytics, and provide personalized services and advertising. Some tracking technologies may constitute a “sale,” “share,” or use for “targeted advertising” under applicable state privacy laws. You may opt out of such tracking by using Global Privacy Control (GPC) or the opt-out mechanisms in your account settings.
III. HOW WE USE YOUR INFORMATION
We use the collected information for purposes that are necessary for providing the Services and supporting our business:

- Personalization & Improvement: To customize the content you see, monitor the performance of our Services, conduct research and analysis, and develop new features.
- User Interaction: To enable teams, organizations, and other users (family, friends) to share and view User Content and facilitate in-app communications.
- Marketing & Advertising: To communicate with you about our own products and services, and (with your consent) those of third parties.
- Security & Enforcement: To protect the quality and integrity of our systems, enforce our Terms of Use, and carry out billing and collection.
IV. SHARING YOUR INFORMATION
We may disclose Personal Information to the following parties:
- Affiliates & Service Providers: To our subsidiaries, affiliates, and trusted third-party contractors who provide services on our behalf (e.g., payment processing, web hosting, marketing).
- YouTube API: If you connect your account to a YouTube Channel, we will share video data with the YouTube API Services on your behalf. The YouTube API Services are bound by their own privacy policy which can be found here: http://www.google.com/policies/privacy
- Third-Party Services: Connected third-party services (including YouTube API Services, social media integrations, and partner platforms) are governed by their own terms of service and privacy policies. Diamond Kinetics is not responsible for the privacy practices of such third parties. You may revoke third-party access through the applicable service’s settings.
- Business Transfers: To a buyer or successor in the event of a merger, acquisition, restructuring, or other transfer of assets.
- Sports Organizations & Partners: To third parties that you may participate in or have the option to provide information to, such as Major League Baseball (MLB), governing bodies, leagues, clubs, and other specific partners (e.g., USA Baseball, Sports Recruits). Categories of information shared with sports organization partners may include performance and athletic data, User Content (including video and livestream content), and contact information. Such sharing supports player development, league administration, and MLB-affiliated youth engagement programs. You may opt out of non-essential partner sharing by contacting privacy@diamondkinetics.com.
- Other Users: To other users and public platforms (like Facebook and YouTube) as necessary to facilitate the permitted sharing and viewing of User Content (e.g., live streaming).
- Legal Compliance & Safety: To comply with any court order, law, or legal process, or if we believe disclosure is necessary to protect the rights, property, or safety of Diamond Kinetics, our customers, or others.
Note on Text Messaging Data: We will not share your telephone number or text messaging originator consent for third-party direct marketing purposes.
Mobile Messaging: Service-related text messages (e.g., account alerts, transaction confirmations) are sent as part of providing the Services. Marketing text messages require your separate opt-in consent, which is not a condition of any purchase. You may opt out of marketing messages at any time by replying STOP or adjusting your account preferences.
V. CHILDREN UNDER THE AGE OF 13 AND MINORS
The Services are not directed toward children under the age of 13 without the consent of a legal guardian.
- Under 13: We do not knowingly collect Personal Information from children under 13 without express parental consent. If we learn we have collected such information, we will delete it.
- Verifiable Parental Consent: Before collecting personal information from a child under 13, Diamond Kinetics will provide direct notice to the parent or guardian describing the information to be collected, how it will be used, and whether it will be disclosed to third parties, and will obtain verifiable parental consent through a method reasonably calculated to ensure the consenting person is the child’s parent or guardian.
- Parental Rights: Parents and guardians may at any time review the personal information collected from their child, request correction or deletion of that information, and refuse to permit further collection or use. To exercise these rights, contact privacy@diamondkinetics.com.
- Third-Party Disclosure Consent: Where personal information collected from a child under 13 will be disclosed to third parties for purposes not integral to the Services, Diamond Kinetics will obtain separate verifiable parental consent for such disclosure.
- Minors (Ages 13-18): As set forth in our Terms of Use, users under the age of 18 are subject to the supervision and consent of a parent or legal guardian (the Account Holder). If you, as a parent or guardian, provide us with a child's Personal Information, you expressly consent to our use of that information as described in this policy.
If you believe we have unauthorized information about a child under 13, please contact us immediately.
VI. YOUR PRIVACY RIGHTS AND CHOICES
You have choices regarding how your information is used:
- Tracking Technologies: You can set your browser to refuse cookies, though some parts of the Services may not function properly if you do.
- Marketing Opt-Outs:
- You can opt out of receiving promotional emails from us by following the unsubscribe link in the email.
- If you do not want us to share your Personal Information with unaffiliated third parties for promotional purposes, you can opt-out by adjusting your user preferences in your account profile or emailing us at the address below.
- Access, Correction, and Deletion:
- You may request a copy of the Personal Information we have collected about you, request a correction of inaccurate information, or request deletion of your Personal Information.
- Note that deleting Personal Information usually requires deleting your entire user account. We may retain certain information as required or permitted by law (e.g., for tax records or to maintain an active transaction history).
- You can always revoke access to your YouTube channel, if you have one connected, by visiting the Google security settings page at https://myaccount.google.com/connections?filters=3,4&hl=en.
- State Privacy Rights (e.g., California, Virginia): Residents of certain US states may have additional rights, including the right to opt-out of the "selling" or "sharing" of Personal Information (used for targeted advertising). We endeavor to honor Global Privacy Control (GPC) signals and provide mechanisms within your account profile for these requests.
DATA RETENTION
We retain personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. Children’s personal information is retained only for so long as reasonably necessary to fulfill the purpose for which it was collected. Upon verified parental request, we will delete personal information collected from a child under 13 within a reasonable timeframe, subject to applicable legal retention requirements.
VII. DATA SECURITY, TRANSFERS, AND CONTACT
Data Security
We use generally accepted security measures, including firewalls and secure operating environments, to protect your Personal Information. However, no data transmission over the internet is 100% secure. Any transmission of Personal Information is at your own risk.
De-Identified and Aggregated Data: Diamond Kinetics may create de-identified, aggregated, or service-generated analytical data derived from your use of the Services. Such data does not identify you personally and may be used by Diamond Kinetics for any lawful business purpose, including product improvement, research, and benchmarking. You retain ownership of your User Content as described in our Terms of Use.
International Data Transfers
The Services are controlled from the United States. Any information you provide may be stored, processed, and accessed in the United States or other countries, which may have different data protection laws. We will handle your Personal Information in accordance with this policy regardless of where it is stored.
Changes to Our Privacy Policy
We will post any changes to this policy on this page, with the revised date listed at the top. Your continued use of the Services after we make changes constitutes acceptance of those changes. For material changes to practices concerning children’s personal information, Diamond Kinetics will provide direct notice to parents or guardians where required by applicable law before implementing such changes.
